1. Definitions
Throughout these Terms and Conditions, the following words have the meanings below:
- "Academy", "we", "us", "our" refers to Panya Academy, operated at 401 Sukhumvit 71, Watthana, Bangkok 10110, Thailand.
- "You", "User", "Student" refers to any individual who accesses this website or enrolls in a course.
- "Course" refers to any online learning programme offered by Panya Academy, including Foundations of AI Development, Applied Machine Learning, and AI Engineering Career Track.
- "Content" refers to all materials, lessons, exercises, videos, written guides, code examples, and other learning resources made available through a Course.
- "Platform" refers to the website at panyaaca.club and any associated learning environment used to deliver Courses.
- "Agreement" refers to these Terms and Conditions together with any enrolment confirmation and the Privacy Policy.
- "Fee" refers to the course price payable at enrolment, denominated in Thai Baht (฿).
2. Acceptance of Terms
By submitting an enrolment enquiry, completing a payment, or accessing any part of a Course, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are enrolling on behalf of an organisation, you represent that you have authority to bind that organisation.
If you do not agree with any part of these terms, please do not proceed with enrolment or use of the Platform.
3. Service Description
Panya Academy offers online courses focused on AI development, delivered via a digital learning platform. Courses are self-paced within a structured weekly schedule and include written lessons, practical exercises, and access to mentor feedback.
We currently offer three programmes:
- Foundations of AI Development — 12-week introductory course at ฿7,400.
- Applied Machine Learning — 16-week intermediate course at ฿10,800.
- AI Engineering Career Track — 24-week advanced programme at ฿13,800.
Course content is delivered in English. Courses are available to learners in Thailand and internationally, subject to payment processing availability in your region. We reserve the right to modify, update, or discontinue course content with reasonable notice where operationally necessary.
4. Student Accounts
4.1 Registration
To access course materials, you will be required to create a student account using a valid email address. You agree to provide accurate, current information at the time of registration and to keep your account details up to date.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. Please do not share your login details with others. If you suspect unauthorised access to your account, notify us promptly at [email protected].
4.3 Account Termination
We may suspend or close an account if we have reasonable grounds to believe the account is being used in breach of these Terms. Where possible, we will notify you in advance and offer an opportunity to resolve the matter.
5. Your Responsibilities
5.1 Acceptable Use
You agree to use the Platform and course materials for personal learning purposes only. You must not:
- Share, redistribute, or reproduce course materials without written permission from Panya Academy.
- Use the Platform in a way that could damage, disable, or interfere with its operation.
- Attempt to gain unauthorised access to any part of the Platform or to other users' accounts.
- Submit work that is not your own, or engage in any form of academic misconduct.
- Use course content for commercial purposes without prior written authorisation.
- Post or transmit harmful, offensive, or unlawful content in any course discussion area.
5.2 Academic Integrity
We ask that exercises and assignments you submit reflect your own understanding and effort. Working through problems yourself is essential to making progress in technical study. If you receive help from others — including AI tools — please acknowledge it.
5.3 Engagement
We encourage steady, regular engagement with course materials. While we understand that life circumstances vary, consistent participation supports your learning. Mentor time is a shared resource; please be considerate of other students when scheduling reviews or submitting questions.
6. Intellectual Property
6.1 Our Content
All course materials, lesson text, code examples, exercises, and other content made available through the Platform are owned by or licensed to Panya Academy. These are protected by copyright and other intellectual property laws.
6.2 Your Licence
Upon enrolment and payment of the applicable Fee, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use course materials for your own learning during the course access period. This licence does not permit redistribution, resale, or sublicensing.
6.3 Student Work
You retain ownership of original work you create during a course. By submitting work for mentor review or sharing in group discussions, you grant Panya Academy a limited licence to use that work for feedback and internal training improvement purposes.
7. Payment Terms
7.1 Fees
Course fees are listed in Thai Baht (฿) and are payable in full at the time of enrolment unless otherwise agreed. Prices include applicable taxes where required by Thai law.
7.2 Payment Methods
We accept payment via the methods indicated on the enrolment page. Payment processing is handled by a third-party provider; Panya Academy does not store payment card information.
7.3 Refund Policy
If you wish to withdraw from a course:
- Within 7 days of enrolment, and before accessing more than two lessons, you may request a full refund by contacting [email protected].
- After 7 days or after accessing course content beyond two lessons, fees are generally non-refundable. We will consider individual circumstances on a case-by-case basis where there are valid reasons for withdrawal.
Refund requests should be submitted in writing. We aim to process approved refunds within 14 business days.
7.4 Course Transfers
If you wish to transfer your enrolment to a different course or defer your start date, please contact us at least 7 days before your scheduled start. We will do our best to accommodate reasonable requests, subject to availability.
8. Enrolment & Course Access
8.1 Confirmation
After successful payment, you will receive an enrolment confirmation email with instructions to access the Platform. If you do not receive this within one business day, please check your spam folder and then contact us.
8.2 Access Period
Course access is provided for the duration of the course plus a reasonable additional period (typically 60 days) to allow you to revisit materials. Access periods may be extended at our discretion.
8.3 Course Start
Courses may have scheduled cohort starts or be available on a rolling enrolment basis. The expected format will be communicated at the time of enrolment. We reserve the right to postpone or reschedule a cohort start with appropriate notice if minimum numbers are not reached.
8.4 Completion
Completion of a course requires engagement with lessons and submission of exercises as specified in the course guide. We do not issue certificates of completion, but you are welcome to refer to your completed coursework in a personal portfolio or profile.
8.5 Technical Requirements
You are responsible for ensuring you have appropriate hardware, software, and internet access to participate. Minimum requirements are listed on the course page. We do not offer refunds for technical incompatibility on the student side.
9. Disclaimers
The Platform and all course content are provided on an "as is" basis. While we work carefully to keep materials accurate and current, we make no representation that:
- The Platform will be available without interruption or error at all times.
- Course content will reflect every current development in a rapidly evolving field.
- Completing a course will lead to any specific employment outcome or technical proficiency level.
Our courses are educational programmes. The skills you develop depend on your engagement, effort, and prior background. We aim to give you solid foundations and practical experience, but we are not able to determine outcomes on your behalf.
Nothing in these Terms constitutes professional or career advice. Any guidance provided by mentors is offered in good faith for educational purposes.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Panya Academy's total liability to you in connection with any course or these Terms shall not exceed the Fee you paid for the relevant course.
We shall not be liable for indirect, incidental, consequential, or special damages, including loss of income or opportunity, even if we have been advised of the possibility of such loss.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under Thai law, including rights under the Consumer Protection Act B.E. 2522.
We are not liable for circumstances beyond our reasonable control, including but not limited to internet outages, force majeure events, or third-party platform failures.
11. Indemnification
You agree to indemnify and hold harmless Panya Academy, its staff, mentors, and representatives from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or any content you submit that infringes the rights of a third party.
12. Termination
12.1 By You
You may withdraw from a course at any time. Withdrawal does not automatically trigger a refund; please refer to Section 7.3 for the applicable refund terms.
12.2 By Us
We may suspend or terminate your course access if you breach these Terms, particularly provisions relating to acceptable use or academic integrity. Where the breach is remediable, we will give you notice and a reasonable opportunity to address it before taking action.
12.3 Effect of Termination
On termination or withdrawal, your access to course materials will cease. Sections 5, 6, 9, 10, 11, and 13 of these Terms survive termination and continue to apply.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by and interpreted in accordance with the laws of Thailand. Any dispute arising from or related to these Terms shall be subject to the jurisdiction of the courts of Thailand.
13.2 Informal Resolution
We encourage you to contact us in the first instance if you have a concern. Most issues can be resolved through straightforward communication. Please write to us at [email protected] with a description of your concern and we will respond within 5 business days.
13.3 Formal Proceedings
If a dispute cannot be resolved informally within 30 days of raising it with us, either party may pursue their rights through the Thai court system or, where both parties agree, through mediation or arbitration under applicable Thai rules.
14. General Provisions
- Entire Agreement: These Terms, together with the enrolment confirmation and Privacy Policy, constitute the complete agreement between you and Panya Academy regarding use of our courses and Platform.
- Severability: If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full effect.
- Waiver: Our failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a business transfer, provided your rights under the Terms are not materially reduced.
- Notices: Notices from us will be sent to the email address on your account. Notices to us should be sent to [email protected] or to our postal address below.
- Language: These Terms are written in English. In the event of any inconsistency between an English version and a translated version, the English version prevails.
15. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, applicable law, or operational practice. When we make material changes, we will notify enrolled students by email at least 14 days before the changes take effect.
Continuing to use the Platform or remain enrolled in a course after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the changes, you may withdraw from any active course before the effective date; please refer to Section 7.3 for refund eligibility.
